These terms govern the vertaaux.ai service operated by Digitaltableteur. Please read carefully; continued use means you agree.

1. Terms of Service (TOS)

1.1 Overview

These Terms govern your use of the vertaaux.ai website, application, and related tools provided by Digitaltableteur. By using the Service, you accept these Terms. If you do not agree, do not use the Service.

1.2 Eligibility

You must be at least 18 and legally able to enter a contract under Finnish, EU, and applicable international law.

1.3 Nature of the Service

VertaaUX provides automated audits (UX reviews, accessibility scans, heuristic analyses, technical signals, predictive heatmaps, and similar evaluative metrics). You acknowledge:

  • Outputs are machine-generated and may contain inaccuracies.
  • Results are informational only and not professional advice.
  • No guarantee of correctness, completeness, validity, or fitness for purpose.

1.4 Accounts & Access

  • Registered users may access additional features; paid tiers add premium access.
  • You are responsible for credentials and all activity under your account.

1.5 Service Availability

  • We may update, change, pause, limit, or discontinue the Service at any time.
  • We are not liable for downtime, data loss, corruption, or connectivity failures.

1.6 Payment & Billing

  • Paid features may require a subscription.
  • Charges are billed via third-party processor (e.g., Stripe).
  • Prices may change with notice.

1.7 Intellectual Property

  • All code, algorithms, branding, and content belong to Digitaltableteur unless stated otherwise.
  • Users retain ownership of submitted URLs or materials.
  • By submitting a URL, you grant us a non-exclusive license to process that content for audit generation.

1.8 Prohibited Use

  • Reverse engineer, scrape, overload, or disrupt the Service.
  • Use the Service for illegal or harmful purposes.
  • Submit data you do not have the right to process.

1.9 No Warranties

The Service is provided “as is” without warranties of any kind.

We expressly disclaim guarantees of accuracy, reliability, or error-free operation.

1.10 Limitation of Liability

  • We are not liable for loss of revenue, profits, business, or opportunities.
  • We are not liable for data loss, corruption, or security incidents.
  • We are not liable for incorrect, misleading, or incomplete audit results.
  • We are not liable for indirect, incidental, consequential, or punitive damages.
  • Total liability is limited to fees paid in the past 12 months, or €0 for free users.

1.11 Indemnification

You will indemnify and hold harmless Digitaltableteur and its representatives from claims, damages, or losses arising from misuse of the Service, violation of third-party rights, or violation of these Terms.

1.12 Governing Law

Finnish law governs these Terms, with appropriate consideration for EU regulations (including GDPR), international commercial norms, and U.S. data-processing/export-control compliance. Disputes are resolved in the District Court of Helsinki.

1.13 Changes to the Terms

We may revise these Terms at any time. Continued use constitutes acceptance of changes.

2. Privacy Policy (GDPR-Compliant)

Digitaltableteur acts as Data Controller for vertaaux.ai.

2.1 What We Collect

  • Account information (name, email, password hash)
  • URLs submitted for auditing
  • Usage logs
  • Payment information (processed by a third party; not stored by us)
  • Technical metadata (IP address, browser agent)

2.2 Legal Basis for Processing

  • Contract necessity (providing the Service)
  • Explicit consent (analytics, cookies)
  • Legitimate interest (security, fraud prevention)

2.3 How We Use Data

  • Provide automated UX and compliance audits
  • Improve system performance
  • Maintain account access
  • Provide customer support
  • Prevent abuse or misuse

2.4 Data Retention & Deletion

  • Audit results and URLs are stored only as long as needed for functionality or user account history.

2.5 International Data Transfers

We primarily operate within the EU. Providers may transfer data internationally under Standard Contractual Clauses, EU–US Data Privacy Framework, or adequacy decisions where applicable.

3. Data Processing & Retention Policy

3.1 Purpose of Processing

Deliver automated UX/audit functionality requiring temporary processing of user-submitted URLs and metadata.

3.2 Categories of Processed Data

  • URL and webpage structure
  • Page content for heuristic scoring (not stored beyond audit generation unless user saves a report)
  • Technical performance metrics
  • Accessibility signals
  • Behavioral predictions (e.g., heatmaps)

3.3 Retention Periods

  • Free scans: may be deleted at any time.
  • Logged-in scans: retained during account usage or until deleted.
  • Paid scans: retained for report history unless deleted by the user.

3.4 Your Responsibilities

You confirm you have the legal right to submit any URL or data entered into the Service.

4. Liability Disclaimer

This Service performs automated evaluations only. Digitaltableteur and Petri Lahdelma disclaim responsibility for errors in audits or scoring, incomplete or misleading results, incorrect accessibility findings, lost revenue, SEO impact, conversion issues, business harm, data corruption/deletion, or third-party content issues. Use the Service at your own risk.

5. Acceptable Use Policy (AUP)

Violations may lead to suspension or termination.

  • Do not submit illegal, harmful, or copyrighted material without rights.
  • Do not test URLs you are not authorized to access.
  • Do not attempt to break, overload, or reverse engineer the platform.
  • Do not bypass paywalls or access controls.
  • Do not interfere with others’ use of the Service.

6. Cookie Notice

EU users are presented with a consent banner per GDPR and the ePrivacy Directive.
